Terms of Use, Privacy Policy, and Intellectual Property
1. GENERAL CONDITIONS
a. Acceptance of Terms. By accessing WHP's family of websites, including https://www.wholistichealthplanning.co.uk/ and other WHP owned websites, (collectively, "the Site"), you agree to be bound by the terms and conditions described herein ("Terms of Use") and any subsequent changes, as it may be updated from time to time. Except as specifically stated otherwise, these Terms of Use set forth the entire understanding relating to this subject matter.
b. Severability. If any provision of the Terms of Use is held to be invalid or unenforceable by any law, rule, order, or regulation of any government or by the final determination of any state or federal court, all remaining provisions hereof will remain in full force and effect.
c. Choice of Law. By accessing the Site you agree that international statutes, laws, and regulations, without regard to conflicts of law principles, will apply to all matters relating to use of the Site.
d. Foreign Access. The Site is controlled and operated in whole or by WHP in the United Kingdom. WHP makes no representation that the content in the Site is appropriate or available for use in other locations, and access to it from territories where the content may be illegal is prohibited.
e. Termination of Access. WHP reserves the right in its sole discretion to refuse or terminate access to the Site by you at any time.
2. PRIVACY POLICY
a. Anonymous Data Collection. WHP may gather from users of the Site, non-personal identifiable information (“Non-personal Information”) that web browsers, depending on their settings, may make available. That information may include, inter alia, the user’s IP address, operating system, browser type, and the pages a user visits.
WHP analyzes such Non-personal Information to help WHP better understand how the Site is being used and for business and marketing related purposes. From time to time, WHP may also share Non-personal information as collected and/or in the aggregate, with our business partners and advertisers, for marketing purposes and/or to improve acquisition channels.
b. Voluntary Data Submission. From time to time, when users of the Site request further information about WHP and its program offerings, WHP may ask for personal identifiable information (“PII”), which may include contact information, email, gender, and/or age. PII may be used for internal marketing purposes, to contact users about the program for which they have expressed interest to personalize correspondence, and/or to distinguish adults from minors. From time to time, WHP may also use PII to offer Site users the opportunity to participate in contests, giveaways and other promotions. Any PII provided to WHP in connection with such activities will be treated in accordance with this privacy policy.
c. Use of "Cookies."
1st Party Cookies
A “cookie” is a small text file placed on a user’s computer used to store information about the user. WHP may use cookies to track the pages that users to the Site visit during their online session, for marketing and advertising purposes, to help WHP improve users’ experiences, and/or to help WHP understand how the Site is being used.
Users who do not wish to have cookies placed on their computers should disable cookies through their web browser settings, with the understanding that disabling cookies may diminish a user’s experience on the Site and that certain features of the Site may not function properly without the aid of cookies. Cookies are not harmful and cannot introduce viruses or extract PII.
3rd Party Cookies
WHP may allow third party companies to set and access their own cookies. Such “third party cookies” are used to collect data about the Site’s traffic, for statistical analysis about the advertisements on the Site and to further customize and enhance a user’s experience on the Site. Third party cookies may also be used for traffic and conversion analysis and/or remarketing purposes, which may include, inter alia, promoting display ads based upon users’ past behavior, showing WHP ads across the Internet and providing reporting on users’ interactions with our ad services. WHP does not control third party cookies and third party cookies are not governed by this Privacy Policy, but rather are governed by the privacy policy of the third party companies.
Users may choose to opt out of or disable third party cookies. Advertisers may allow users to opt out of ads by visiting their websites and customizing the user’s ad settings.
d. Disclosure of Information. If users opt-in to receive company marketing materials or other promotional items, WHP will provide such users’ first and last names and email information to third parties, so that those third parties may fulfill such requests. As explained below, users may opt out of receiving emails from WHP at any time. However, even after opting-out of WHP emails, a user may continue to receive marketing emails from third parties to whom WHP already has provided the user’s email information including (delivery companies, questionnaire software, etc) who will never sell or wittingly pass on your data for the purpose of direct 3rd party marketing. Users are responsible for directly contacting such third parties to request removal from email lists.
WHP discloses PII when required to do so by law, or when WHP in good faith believes such action is necessary to protect the property or rights of WHP third parties or the public at large.
e. Contacting You. WHP may use your contact information to inform you of changes to the Site, or, if requested, to send you additional information about WHP. WHP has a no-spam policy and provides you with the ability to opt-out of our communications by selecting the unsubscribe link at the footer of all e-mails. WHP will not sell, rent or share your email address, and you may unsubscribe at any time through the unsubscribe link at the footer of all e-mail communication.
f. Assignment of Rights. In the event of an assignment, sale, joint venture, or other transfer of some or all of WHP’s assets, you agree WHP may assign, sell, license or transfer any information that you have provided to us.
3. INTELLECTUAL PROPERTY
Any unauthorized use of any material contained on this Site may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. WHP monitors use of its copyrighted material on the Internet and will seek legal action against any infringing parties.

All content found on WHP’s site, except as noted otherwise, is exclusively and solely owned and copyrighted by WHP and/or its affiliates. No such content may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means including, but not limited to, electronic, mechanical, photocopying, recording or otherwise, without WHP’s prior written consent. You may not "mirror" any content contained on this Site without express written consent from WHP.

4. SECURITY
WHP takes reasonable precautions to protect information that has been provided to WHP by Site users. When users submit sensitive information via the Site, all information is protected both online and off-line. However, due to the nature of the Internet, WHP cannot completely ensure, guarantee, or warrant the security of any information transmitted to us or through our Site. Submitting information is done at your own risk. WHP has security measures in place to prevent the loss, misuse, and alteration of the information that WHP obtains from you, but WHP makes no assurances about our ability to prevent any such loss, misuse, to you or to any third party arising out of any such loss, misuse, or alteration.
5. THIRD PARTY LINKS
The Site may contain links to third-party websites that are not controlled by WHP. If you choose to visit such websites, WHP is not responsible for the privacy practices or content of those websites, and it is your responsibility to review the terms and privacy policies of those websites to confirm that you understand and agree with their policies.
6. DISCLAIMER
a. No Warranties. Information on the Site is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
b. No Liability. In no event will WHP be liable for damages of any kind relating to use of the Site, including without limitation any special, indirect, incidental, or consequential damages, even if WHP has been advised of the possibility of such damages.
c. Accuracy. Although every effort is made to ensure the accuracy of published information on WHP’s web pages, the Site may inadvertently contain technical inaccuracies or typographical errors. This information may be changed or updated without notice. WHP assumes no responsibility for errors or omissions on the Site or in documents referenced by or linked to the Site.
7. MODIFICATIONS
WHP reserves the right to change the Site, these Terms of Use, or the policies and conditions that govern the use of the Site at any time. Please review this page periodically for any updates or changes. These Terms apply to all visits to the Site, both now and in the future. Your continued access of the Site shall be deemed your notification and acceptance of these changes.
